On August 17, 2022, the border guards detained two persons - one citizen of Moldova, and one citizen of Ukraine - for using forged documents.
At the “Terehova” border control point, a citizen of Moldova, born in 1962, who, while crossing the state border by car, presented a forged driver’s license of Russian Federation to the border guards, was detected.
Meanwhile, at the “Grebņeva” border control point, the border guards performed an inspection of a passenger car entering the Republic of Latvia. The driver of the vehicle, a citizen of Ukraine, born in 1986, presented a forged driver’s license of Ukraine to the border guards during the document check.
In both cases, criminal proceedings have been initiated for the use of forged documents in accordance with Article 275 (1) of the Criminal Law. After carrying out all the necessary criminal procedural actions, both criminal processes have been forwarded to the East Latgale Prosecutor’s Office for the initiation of criminal prosecution. Each of the offenders was fined EUR 1,500 for committing a criminal offence by order of the East Latgale prosecutors.
The Criminal Law stipulates that for a person who commits forgery of a document conferring rights or a release from obligations, of a seal or a stamp, as well as commits using or selling of a forged document, seal or stamp, the applicable punishment is the deprivation of liberty for a period of up to one year or temporary deprivation of liberty, or probationary supervision, or community service, or fine, but in cases where it is done for greedy purposes, or if it has been committed by a group of persons according to a prior agreement, or if substantial harm has been caused thereby to the state authority or administrative order, or to the interests of a person protected by law, the applicable punishment is the deprivation of liberty for a period of up to three years .
